Selling Digital Services Globally with a Tax-Free US LLC

You're closing a consulting deal from a café in Lisbon. Next week you're writing code for a startup in San Francisco while working from the mountains of Georgia. You're location-independent — but how does the business side actually work?

WHY THE US LLC IS THE PERFECT HOME FOR YOUR DIGITAL BUSINESS

For a location-independent service provider — consultant, coach, developer, designer, marketer — the US LLC is not just one option. It is the most elegant solution available.

Global credibility: An invoice from “Your Service LLC” out of Wyoming, USA carries a different weight than an invoice from “John Smith, currently in Thailand.” You are immediately perceived as a serious, international business.

Access to the best financial infrastructure: A US LLC opens the door to the US financial ecosystem. You get a Mercury business account and can use Stripe — the gold standard for online payments. That alone solves 90% of the practical problems a nomad faces.

Liability protection: The LLC separates your personal assets from business risk. If a client sues, your personal savings are protected. That is basic business hygiene.

Zero US federal income tax: If you are a foreign owner with no employees, no office, and no fixed place of business in the US, and you sell digital services to clients worldwide, you are generally not engaged in a US trade or business (ETBUS). Your income is treated as foreign-source income. The result: no US federal income tax on your profits.

WHO CAN ACTUALLY BE TAX-FREE — AND WHO NEEDS TO BE CAREFUL

“Zero US tax” is fantastic. But does it mean you pay no taxes anywhere? The answer depends entirely on your personal tax residency situation.

The ideal case: If you have properly deregistered from a high-tax country and are either a perpetual traveler with no fixed tax residency, or a resident of a territorial or zero-tax jurisdiction (UAE, Panama, Paraguay, etc.), the structure is clean: your LLC earns profits, pays no US income tax, and you pay no personal income tax in your country of residence because either there is no income tax, or foreign-sourced income is exempt.

The important caveat: “Zero US tax” does not mean “zero obligations.” Your LLC still has annual filing requirements (Form 5472, annual state reports) and you may have VAT or sales tax obligations depending on where your clients are located.

EU VAT AND US SALES TAX: THE LAYER MOST PEOPLE MISS

Income tax is one thing. Consumption taxes are another. If you sell digital services to private consumers (B2C) within the EU, VAT is due in the customer's country — regardless of where your LLC is based. The solution is to register for the EU's One-Stop-Shop (OSS) procedure, which lets you file and pay all EU VAT through a single portal.

On the US side: if you exceed certain revenue or transaction thresholds with customers in a specific US state, you may trigger an “economic nexus” and become obligated to collect sales tax in that state. For most small service providers this risk is initially low, but it grows with success.

THE IDEAL SETUP

1. Clarify your personal tax situation first. Where are you (or will you be) tax resident? This is the single most important question.

2. Form your LLC properly. Wyoming or New Mexico, with EIN, registered agent, and a US business bank account.

3. Use Stripe for payments. Your LLC invoices clients, Stripe processes payments, funds land in your Mercury account.

4. Manage your VAT obligations. If you have EU private customers, plan for OSS registration proactively.

5. Stay compliant. Annual Form 5472, state annual reports, and registered agent fees are non-negotiable.
